Chongqing Woman Dragged To Death By Porsche For Car Key

In the afternoon of the 25th [September], at 4:45pm, a woman driver driving past the main entrance of a 恒大华府 [hengdahuafu?] had a minor accident with a BMW. Witnesses said that the BMW driver immediately called a Porsche SUV, and a quarrel raised between the three of them. Trying to get back her car key from the Porsche driver, the woman was crushed to death after been dragged by the Porsche 20 metres.

According to the eyewitnesses, on that day around 4:45pm a red BMW and a Santana had a minor accident at the main entrance of the 恒大华府 [hengdahuafu?], the left-rear wheel of the BMW was damaged. The BMW driver got out of the car to dispute with the young woman driving the Santana and demanded compensation. The woman refused and demanded the matter to be resolved by the traffic police. The BMW driver took his mobile and called over a black Porsche SUV. “The driver was young, about 20-year-old, and speaks Putonghua [Mandarin]“, a witness reported. The Porsche driver took the key for the Santana from the woman during the dispute and immediately started his own car to leave.

“She pulled at the door of the Porsche and ran along”, a witnessing cleaner said. She saw the young woman firmly grab the door of the slow-driving Porsche not allowing the other party to leave and cried, “Why have you taken my car key?” The other party did not answer but accelerated. After being dragged for 20 metres, the woman was hit by the rear wheel of the Porsche at the head and the chest, dying at the scene. The two drivers ran away. The surrounding bystanders took photos of the scene, noted the number plates of the hit-and-run cars and informed the police.

Insiders said that the name of the deceased is Tian, 28-years-old. At present, the hit-and-run driver has been detained by the Chongqing police. The case is being investigated.

Driving a car and getting into minor accidents is a very common thing. At worst, just get out and give a phone call to the insurance company.
What do the two parties have to quarrel about? Also, not to be harsh, some Chongqing women are very overbearing, can set up people on fire…We were not at the scene, don’t know the exact course of events, but certainly both sides were at each other’s throats, nobody is stepping back…
Because that BMW guy was also foolish, he destroyed his own friend because of a woman…
None of three people are worth it…

Certainly, the deceased who hung onto the car had some responsibility as well.

  1. What is AN appropriate punishment? Death by the bullet? Manslaughter? In China the laws aren’t even clear. I know in the past, Chinese offenders would reverse their cars in a traffic accident in hopes of killing the victim to avoid lifetime of payments to cover their rehabilitation expenses. They would make a lump sump payment to cover the victim’s funeral and as appeasement to the family but it was horribly low. Now? I’m sure payments could made to the judges to give leniency to the offender in return for a death penalty to be commuted to a life sentence or maybe even house arrest…who knows? But money can move mountains in China. THAT’S A FACT and not a myth!

The lady justice of this country must have a blindfold made of money. Also it is true that the only reason these rich have such audacity is because they have enough connections to bend the rule of law. Only time will tell how long the majority making a honest living can endure such a sight.

  6. This is really sad AND it makes you angry to think of the selfishness that led to this tragedy. This was not the woman’s fault but it reminds us that it is not wise to be too stubborn in such situations and get yourself killed over material goods and at the hands of hotheads.

    If this happened in the States the drivers would spend years in prison but in China I’m afraid they can pay off the police and the judges and get off without appropriate punishment.

  7. An event like this needs to be kept under the scrutiny of the media spotlight if it is to avoid what we feel is the inevitable outcome.

    A free press is what is really required to call to account the endless instances of endemic corruption. Unfortunately the press isn’t free and those with power can decide to some extent what we read.

    Please China Smack, everyone, make sure we keep the progress of this story and others like it in the public domain, keep up the pressure and demand justice, otherwise nothing will ever change.

  8. Wait what? Why does everyone think that this case will not be resolved? The perpetrator doesn’t even seem like he has strong political backbone. Please give me an example of a similar case where the murderer obviously killed someone and get left off the hook because of money. Maybe Chinese courts are really that corrupt that anyone who have a little money can get out of murder cases, I don’t know.

    Only SOME incidents are followed closely by the media. You think every driveby verdict in LA is reported in the news? You think it should be? Ridiculous for you to make the speculation this is a China-only incident, news isn’t news unless it’s new, most people don’t really *care* about the follow-up months after the actual incident occurs…only the emotional outburst caused by the initial read. Now, we’re all thinking “I hope [this] happens to that guy!” but then quickly forget about it – as does the media.

    Thank you! Finally someone not jumping to the instantaneous conclusion of “OH This guy drives a BMW He’ll CLEARLY not get punished because he’ll pay the judges and the police!” bullshit. There is not NEARLY as much corruption as people seem to think at this level – most corruption in China is WHITE COLLAR…get it? Take some officials to KTV and give a car or apartments to authorize a real estate development when it shouldn’t be, NOT “Oh here’s a bag of money let me flee to switzerland after crushing a girl with my car”.

    I’ve had a problem in the past with a guy driving a new million RMB beemer and the officer was, in fact, pissed off at that guy for being whiny about the situation and trying to ‘assert’ himself as affluent, needless to say – there was no ‘corruption’ ie give me some cash and you’ll win. The guy driving the beemer just got himself in more trouble. After these kind of situations happen to me in person I have earned a lot more respect for Chinese police officers…just have to learn to deal with them respectfully.

    I agree, to a point, but I do find many Chinese like to be view in a monolithic manner anyway. So a part of this China view is their fault.

  14. The term “nationality” has connotations of both ethnicity and citizenship. It’s not synonymous with either of those. It’s a pretty confusing term and it’s used in various ways.

    I think the survey question should be more specific about what it means by “Chinese.” Does this include those of Chinese ancestry who grew up outside China? How about a non-Chinese who grew up in Taiwan, of which there are many?

    To maxiewawa – Many surveys will ask for citizenship or race in one question and then ask a question about a belief later on. Usually they aren’t part of the same question because the researchers don’t want to make respondents feel as if they’re being stereotyped, which is apparently what happened here. I also want to add that analyzing different responses based on background variables may seem like stereotyping, but it can often reveal something interesting. IMO, it’s not necessarily prejudiced to ask the question of race/nationality/citizenship/ethnicity. The prejudice comes in the interpretation.

    By the way, the Porsche driver seems like a jerk, but it’s not obvious from this article that he meant to drag that woman 20 feet. It seems like she kept hanging on, and then was killed by a collision with the back of the car and hitting the concrete. The driver seems stupid and negligent, not to mention a mindless thug for the BMW guy, but not necessarily homicidal.

    That’s more of a case of poor peasant who can’t afford a law suit than rich guy bribe the judicial system. Given that the provincial and national authority are involved to curb public anger, it is highly unlikely that there could be outrageous corruption in this, especially not in the second trial. I mean no amount of money can buy off enraging the public from the central government. Maybe the woman really don’t know how to drive, since she didn’t even take the test.

    Sad really, how little trust people have in the judicial system and how the poor can’t afford to go to court. Maybe with a jury of middle class, people will be less enraged at trials that didn’t went their way. Or maybe they will accuse the rich buying off the entire jury when they don’t agree with the results.

She got her keys taken and then run over!!!Listen, I am just saying that far too many people let themselves be dealt with unfairly. If a woman doesn’t have a boyfriend, brother or uncle of any particular physical prowess she needs to make those affiliations.
    It could be her neighbor or even her friends boyfriend…but barring that…get a tough fuck-buddy or something. It’s a practical solution.
    This is China, and I am sure that LOTS of people witnessed the entire fracas and that no bystanding ‘males’ did shit till she got run over.

    Kai, I am not eager to intervene, but for my friends/lovers etc, I am willing. They know not to bother me with little things, but incidents that have potential to harm my family or friends are legit reasons to call me for help. Yeah, we may have to answer for our actions later, but at least none of my friends have their faces gashed and heads smashed open when I am present (when I have not been present it’s happened to more than one friend…yes, some even in China). I’m not a yelling type of agitator, I am a ‘cooler’.

People don’t call “a” friend if they have that kind of clout, they call a small van full of dudes wearing cheap body armor wielding little steel rods some w/ spikes or tazers and roll up, hop out, and fuck someone up.     I was witness of some bad decisions in traffic quarrel. Once, tough guy, from SUV block the road of some guy in Yugo (google for that). SUV driver went out and walked forward Yugo. Guy in Yugo, drove reverse for ten meters, then accelerated forward, kick the tough, scratch toughs car and run away. And there’s millions of white Yugo’s in Serbia.

    It is better to settle things down then to start mob wars.

  29. Why do so many people think that the obvious punishment is death? Can’t there be other ways to punish people? I think that to punish someone by death is being used so freely here, it seems to be the only option for some opinions. Life is too precious, we can help those people who mess up by providing them with correctional facilities.

    Maybe some people do deserve to die, but I don’t think it should be the first choice. Life is more than dying. We all deserve to be on this planet. Think about it and stop it.

These two drivers will not be punished, why? simple… the police will hold them until the dust to settle down…meaning, people will forget about the incident, then they will pay the police for the “accommodation” charges and release them… someone will pay the victim’s family for compensation and see… case closed..

    This is how the system works.

    Don’t be too naive, rich people don’t do jail time, they don’t suddenly feel sorry and change their way… Life is precious only for rich people..

  33. Rick. I was a partner in a small business on the outskirts of Shanghai. One of my Chinese partners was paid a visit by two young men. One night around 9:30-10 I was working on my motorcycle when the discussion became hostile. I asked the offending party to calm down a bit as we are in a shop…no need for yelling. I went back to minding my business. Not one minute later he was yelling and flipped a table upside down, scattering books and cups and ashes and I had to eject both him and his big friend.
    Once outside I ran them off the property whereupon they stood at the roadside and started dialing their cellphones. I told them to call whomever they liked…so they called 9 friends. Not big guys but they came back after I went inside and back to work. Next thing I knew I was called outside by my friend to greet the ‘gang’. The guy was all brave so I told him to leave and shoved him. Then people started hitting me and 4 guys jumped behind a statue or a stone lion(the place next door was a statue and lawn ornament shop), and reappear with pipes and one with a sword. I was busy fighting a few small monkey-like individuals when the pipe wielders started wacking me. I blocked a few ( they were not thick tubes) and then the original trouble-maker brought a sword into play. I was forced to retreat…and he followed me into the shop, where I grabbed a very light steel tube slightly larger than a curtain rod…and proceeded to mock him “ha-HAA!!” in a fencing stance. Then he ran out and threw the sword at me, and screamed at everyone to run. So run they did. I let them go, but then after looking at the sword on the floor , I decided to go fix them up a bit. I yelled, ” hey assholes come back and play” and ran down the road after them.
    They flagged down regular cars and scooters and begged for rides….hopped fences and scrambled over factory walls.
    I have never seen 11 people move so frantically. a couple of them lost their shoes in the escape. Haaa…

    Anyway. The reason that I feel the Police in the Harbin story weren’t frightened by a skinny kid with a brick is the same reason that I was not afraid of the ‘rat-pack’. I think they went and took revenge on him.

  35. The ridiculousness of this situtation is chongqing in a nutshell. Yes. Somebody should be punished, severely even, for continuing to drive whilst a person is hanging from their car and eventually killing them. If one has the experience of driving a car…. while someone is hanging/grabbing/latching on to the back with rollerblades… that person would know, and it doesn’t take long to realise, that it’s an extremely dangerous situation.

    But Kids, don’t grab onto moving cars. Look both ways when you cross the street. If a car is backing up, don’t stand behind it. If there is a fire, don’t put your hand into it (it could burn you, really).

    Be real. Personal liability counts for something, right??

    So is it a case of manslaughter. Second degree I would assume. Life in prison or the gun, two years in the reform camp, up to you guys, but rememeber it’s going down in history….

  36. Bit of bullshit here, the only thing these guys may get through ‘guan xi’ (relationship) is many years in jail rather than death. Many people throughout the world percieve that law is weak in China, it isn’t, theres just a lot of hopeless lawyers. Get an experienced Lawyer with moral and even a ‘guan xi’ed’ Judge can’t do anything other than reduce the sentence. No smart ass comments about Lawyers with moral thanks, theres actualy plenty of them here.

  37. I am not Chinese, but have a deep love and interest in China, where my wife is from and which I have at this point visited 6 times for at least a month each trip. I think that if the hit and rum driver and his friend have money but not strong guanxi/political connections there is a good chance some sort of justice most probably will be the outcome. I do think that the more public interest and comment on the internet, and media outlets makes it more likely that justice will be done. I do hope so, it’s a tragic, heartless act that of course doesn’t only occur in China, but I do think that until a clear protection clause be written into the law that protects citizens who offer help and take actions that are done with the intention of helping should be protected from any liability or any legal penalty if in their efforts to help the person unfortunate additional injuries happen, or despite would be rescuers efforts the person should die. Having been badly injured in the U.S.A. in automobile accident I may owe my life to the people that helped to get me an ambulance and moved me out of the street after checking, as best they could, that moving me wouldn’t cause further and more serious injuries.

      I guess you came to this piece of news two years late as I do. As one of the poster said: most news were interesting as they were new, and after everyone is finished with their emotional discharged, nobody really cares. This is happening to most of the news in US as I am aware of. Often many cases that I read with a lot of emotions (like discriminational murders) never got followed up even I specifically marked down the stories to purposely searched 3-6 months later; just completely no news like it never happened.

      I am very curious how this case would turn out as well; whether the perpetrators would really hand the judges a bag of money and walked free (which I highly doubt) or they actually got their deserved punishments, give or take. But I am likely to take Rick in China’s assessment and response to corruption allegation in China (which corruption may help getting a development permit, but not blatantly walked free from crimes).

  38. even though i live and work in china, i am not chinese, not all rich people are arragant or carefree, some are decent,pointing to the rich people who do all the bad stuff is not going to resolve any issue, the people should get together and lobby the goverment. its the (BAD MAN) OR THIEF YOU SHOULD WORRY ABOUT, would not hesitate to cut you up to take 10 yuan from your pocket, rich or poor alike

    In China, if having an accident, it is well known that it is always better to kill the person rather than to wound.

    Killing results in a settlement of between 10.000RMB and 20.000RMB… plus public apologies and sorriness.

    Wounding a person can go way pass 100.000RMB
