Summary: The “Hunan Yongzhou 11-Year-Old Young Girl Forced Into Prostitution Case” that caused a sensation many years ago has once again attracted the attention of netizens because of a microblog post by the representing lawyer after the final judicial verdict was handed down.

Gan Yuanchun, the lawyer representing Tang Hui, the mother of the young girl victim, posted information on his personal microblog claiming that [on August 3rd], the Lingling Sub-Bureau of the Hunan Yongzhou City Public Security Bureau [police], citing “disturbance of public order“, sentenced Tang Hui to a year and a half of reeducation through labor. Gan Yuanchun told this Chengdu.cn reporter that although the principal defendant Qin Xing has already been given the death sentence, Tang Hui continued to file complaints with the relevant government departments, hoping to punish all of the Yuanzhou police officers who helped defendant Qin Xing fabricate his “record of meritorious service” [which was cited to lessen his sentence].

Tang Hui’s husband Zhang Hui told this journalist that [on the morning of August 2nd], not long after Tang Hui had gone to work, police notified her to go to the Public Security Bureau to take deal with some matters. Afterward, Tang Hui went to the Lingling Sub-Bureau police station alone. Not long later, four police officers came to their home and had him hand over the previous complaint documents and materials. Tang Hui did not return home that night until the morning of the next day when Zhang Hui received a notice from the Lingling Sub-Bureau police to go to the station to provide a signature. It was only then that he learned that Tang Hui has already been sent to the Baimalong Women’s Reeducation Through Labor Institution in Hunan province to serve one and a half years of reeducation through labor.

As it is known, the “Young Girl Forced Into Prostitution Case” happened in 2006, the victim having been coerced by Zhou Junhui into the leisure center [aka bath center, bathhouse, spa] operated by Qin Xing and Chen Gang to sell sex for as long as 3 months, during which time she was raped by Liu Run, Lan Xiaoqiang, Qin Bin, and Jiang Junjun. Tang Hui hoped that the court would sentence the 7 individuals to death. However in the final verdict, Qin Xing and Zhou Junhui were given the death sentence while the rest were given life sentences or limited sentences.

However, the matter didn’t end here. Tang Hui believed that there were varying levels of misconduct by the police in this case, but they had not received any punishments, and therefore she has been petitioning [filing complaints with] the relevant departments regarding this matter.

According to what Chengdu.cn has learned, in 2010, while Tang Hui’s lawyer was examining documents at the Yongzhou Intermediate Court, he discovered witness testimony claiming that 13 prisoners at the Lengshuitan Detention Center testified that on the afternoon of 2007 June 12th, Qin Xing had saved detainee Zhou Lanlan from committing suicide. Qin Xing’s [legal] representative cited this as “a record of meritorious behavior” hoping that the court would lessen his sentence.

However, this reporter obtained notes/transcripts from a lawyer that indicate that Zhou Lanlan denied that he had any suicidal behavior at the time. According to Gan Yuanchun’s statements, detention center police officer Tang Aiguo and others had fabricated this record of meritorious conduct. Another lawyer involved in this case, Hu Yihua, says: “At this point, I haven’t seen any documents regarding any punishment of the police officers involved.”

      I have read stories in Australia where whole families been wiped out by drunken drivers and the criminals walk away for 3-4 years that’s INJUSTICE

            I think the idea the mother had was to punish the perpetrators of the initial crime, then to punish the friends of the criminals, that just so happened to be police officers, who fabricated false evidence in order to obstruct justice.

            If it was your daughter I am sure you would be enflamed if someone was acting like the crime was not so bad….. etc and even tried to help the perpetrator avoid paying for his crime.

            Actually this Guanxi based social system is what makes it so difficult for ordinary people to achieve justice. Its exactly what will stop ordinary people in China from realizing their dreams. Its what will keep the knives of the rich and powerful at your throats. The term “没办法“ will always be an answer you get when you try to solve a problem because someone more powerful or with more influence is unjustly standing in your way. That mother was right to file petitions. She was following the “law” if you can even call it law according to the proper way to lodge complaints. Actually I think filing complaints is simply a way to be blacklisted by authorities as a trouble maker, which we can see from their handling of this incident.

            Furthermore, we can’t blame the mother. Her child is the most important thing in her life right? Wouldn’t she be? People should not have to be afraid of thugs kidnapping their children raping them and forcing them to become prostitutes! Especially not in such a “harmonious society” like China’s with the tens of millions of prostitutes already available. Why would they need an 11yr old prostitute when there are already so many others who are over 18? I can understand being afraid of such a thing in undeveloped chaotic countries, but not in China.

            Perhaps we should have coffee or tea in Beijing.

I mean, the dude already blamed the entire thing rape on the mother herself, then speculated that she was only complaining so that she could get a cash settlement, and has been constantly saying that justice has been served even in light of the contradictory evidence presented at the trial.

          If you’re lucky, and he replies at all, it’ll either be with a strawman argument or an ad hominem attack wherein he’ll play the victimized Chinese / helpless China card, implying that you’re in some sense the aggressor.

          Most criminal reporting by police in any serious crime in China, Asia or any other country will have a % of misconduct, you can Google and do your own research. If the misconduct resulted her in not getting any justice eg THE CRIMINALS GOT AWAY then yes i would agree she should keep complaining till the end. But people were sentence to death and others jailed. Legal system in every country have flaws and being China with limited resources and corruption this is a MIRACLE!.

          Being a parent in any country should be a privilege not a right..so people who do have them do a better job of protecting them and looking after them..poor rich Asian or white. Why do people always give the parents the “get free card” i mean where were they when these men lured her?

          There are billions of parents on this planet and most seems to be able to keep their children from harm and safe. If a Child is put in danger then they not doing their job.

            Some people will consider this result “enough” justice but others will not. Everyone has different standards.

            Which “government” is right? The local police who sentence her to reeducation through labor? Or the other parts of China’s “government” who also believe this is wrong? What government is right when there is a difference between local and central?

            The central govt should be more authoritative (as opposed to ‘right’) unless a country’s constitution does not allow it to overrule the local govt under certain circumstances.

            The central govt should look into this case and flush out the worms.

Its all to common to just say “the parents are poor migrants” but this is basic common sense to teach your children.         Not full justice….the individuals who are supposed to be the ones protecting citizens (the police) were both implicitly condoning illegal behavior of the accused individuals as well as punishing the mother of the victim because she was trying to shed light on police misconduct.       Tang Hui was released from the re-education camp a few days later, on August 10. She said to Xinhua that she is going to send her daughter to a place far away, and that she will continue to seek justice against those who have not done their jobs properly. I think she should spend more time with her daughter.

            Yeah Fauna she should have the right to question their actions, but she don’t. That’s just how it is. It’s sad and i could imagine being in her situation and just wanting “justice”. I have a story.
            This guy I know in china killed a man while he was drinking and driving. And this guy was going around asking all his friends and family for money for he pay whoever to get off the jail sentence. So my question is” Do you think all the people who gave this guy money to pay off the police or whoever is somewhat to blame too?” And by the way im not china hatin or anything.         the problem is that, the courts do not give these people a trial, the local police can simply sentence you to a reeducation camp, particularly the ones she was trying to file a complaint against. she should have gone to the central government. maybe they would have removed the local parties to save face.

          There are numerous examples of the government failing the Chinese people. I honestly don’t know why people even expect the Chinese courts to represent them. In many regards, China is a lawless society. As such, Chinese citizens should take the law into their own hands. If these police officers simply disappeared, everyone would know what happened and the remaining police officers would be “inspired” to better represent the people.

        That is what I was told by my friends from China. They also told me in China if you have money, you can buy your way out of conviction. China needs to remove 90% of their gov’t officials for they are all corrupted. The other 10% good officials can’t do their work and run the system fairly without corruption. I actually live in a low crime rate college town, that was ranked best place to live in America three times in a row by Money Magazine. The problem is that, like most places there are always underprivileged people, and a criminal element lurking in the shadows.

            America is dangerous. Guns are legal and easy to get. Was once stalked by a police officer, which prompted me to move here from Chicago. Around that time, the officer, some lunatic who used to lurk and peek through a keyhole in my door (it was an old fashioned door), and this drug dealer who tried to force me out on a date (I declined), about thirteen years ago is why I moved here for good. The problem was that, I was easy pickings, not having a man/boyfriend/male relative ever visiting my apartment. Perverts often watch to see who is coming and going from a lady’s house. I often know a guy is a perv if he asks, “You got a man at home”, and I’ve heard that question a lot. To which I answer, YES!

            Love this city. The standard of living is high, overall I feel very safe even if I’m still slightly paranoid at having been preyed upon thirteen years ago in Chi-town.

    It took six years for a case in which an 11-year-old girl was sexually assaulted by a gang and forced into prostitution in Yongzhou, Hunan Province to be resolved. Tang Hui, the victim’s mother, made petitions on several occasions due to dissatisfaction with the judgment, earning herself a one-and-a-half-year labor reeducation sentence from the Yongzhou police. The public is livid over the issue. Yesterday, the Hunan Politics and Law Committee announced it would step in.

    If Tang really disturbed the public order and deserved punishment, the process should be transparent and accepted by the public. However, the reality is that the public is questioning and opposing the punishment. Such a decision has damaged the government’s image. The Hunan Politics and Law Committee quickly organized an investigation group and announced that if there were mistakes made, they will correct them. This shows that there really were some unreasonable aspects involved.

    The possibility that some law enforcement officers abused power in Tang’s case needs to be further investigated. The Hunan High People’s Court closed the case in June by sentencing two criminals to death and four to life imprisonment. It’s not a light punishment. The officials should reflect on why the case still drew public ire.

    If Tang did put forward some unreasonable demands and disturbed the public order, she should be punished. The Yongzhou police listed a series of Tang’s “illegal” activities disturbing social order, including appealing in front of the local courts, blocking the way of officials and making a scene at a judicial branch, and so on. But these activities didn’t severely harm the public’s interests.

    It’s worth noting that China’s petition and labor reeducation system both have loopholes, and can easily lead to controversies. These systems could solve many problems if they were effectively used, but if officials abuse their power, more problems will emerge.

    In the wake of Tang’s case, some have suggested eliminating the labor reeducation system, arguing that it’s not in accordance with the constitution for police to deprive people of their freedom without trial. These arguments pose new challenges to China’s social governance structure.

    China is not a society that strictly abides by the rule of law. Officials should be of high caliber and have the ability to handle complicated situations. But a minority of grass-roots officials put themselves above the public, and think they are the center of the local order. Officials should bear in mind that they are public servants, and are not above the people. In the Internet era, local public crises will easily have a nationwide influence. The officials must adapt to the new environment brought by the Internet.

      A top-level team has been despatched to investigate a case in which the mother of an 11-year-old girl gang raped and forced into prostitution was sentenced to 18 months of “re-education through labor” because of her protests.

      The team, sent to the city of Yongzhou by Hunan Province’s Communist Party Committee, is also to check whether police falsified evidence to get a lighter sentence for one of seven defendants found guilty of gang rape.

      The girl’s mother, Tang Hui, was detained and punished for “seriously disturbing social order” because of her protests outside courts and government buildings in Yongzhou, city police said in an announcement on Sunday.

      Tang “blocked cars and the entrances of the buildings and shouted out loud” on seven occasions between March last year and July this year to demand death sentences for the men charged with gang raping her daughter and forcing her into prostitution.

      Her protests “caused extremely bad social influences,” the police said in its announcement.

      One of her protests was outside the government buildings on June 5 after a court sentenced two defendants to death, gave four others life sentences and jailed the remaining defendant for 15 years.

      One of them, Qin Xing, asked for his death sentence to be commuted as Yongzhou police said he had prevented a woman from committing suicide in jail. That sparked public concern over the falsification of evidence by police officers after it was revealed that Qin was related to a police bureau official.

      In a bid to remove doubts, Yongzhou police made another announcement on Sunday, saying their investigation had shown that Qin did save the woman, Zhou Lanlan, from hanging herself in her cell. They denied police officers had falsified evidence to help Qin have his sentence commuted.

      Zhou, however, told reporters in an interview that she had never tried to commit suicide because she had a daughter, injured as the result of a medical accident, to care for.

      A lawyer for Tang told reporters that Tang had repeatedly asked the court to punish police officers she believed had helped Qin with false evidence but the court refused. She then went to the court and government buildings to protest, the lawyer said.

      Her daughter was kidnapped by criminals who sold her to a nightclub in Yongzhou where she was raped and forced to provide sexual services.

      Over a three-month period in 2006, the 11-year-old girl was forced to have sex more than 100 times, during which she was beaten up and raped.

      The defendants told the girl that her family members would be killed if she refused to work at the nightclub.

      A customer at the club phoned Tang after he had seen pictures Tang had posted of her missing daughter. Tang immediately called the police but nothing was done. It was only when she called them a second time that officers helped to rescue the girl.

The badminton team’s decision to “win at all cost” impinged upon the rights of the other athletes right to pursue their goals. The stated rule of the Olympics is “to play to the best of your ability” (not verbatim). The Chinese team broke this rule and thus prevented the opposing team(s) from playing by the rules and ultimately lead to their dismissal from the competition thereby impinging upon their ability to pursue their goals.

            While a denying a person ability to participate in a athletic competition is not as heinous as raping a young girl, in both cases, one party in their pursuit of “winning at all cost” is denying the rights of another party to pursue their goals.

            Make no mistake, the crime of rape is heinous in my personal opinion, but your lack of thinking and cavalier approach to law and appreciation for the application of your so called “principles” is equally as heinous albeit not as visceral.

      The girl was rescued.
      A customer at the spa recognised her from a picture and rang her mother. Her mother had to ring the police TWICE to get a rescue happening.This was in 2006, the girl would be about 17 now. God help her, that must have been a fucked up 2 months.
      Her mum is in jail for 1 1\2 year doing re-education and misses her daughter a lot.
      Here’s to all the good people in the world, I hope I am one of them.

        Thanks for your reply. I really hope the girl will be ok now despite what happened to her. I think with the right therapy she can go on to live a good life. I realize her mother wants more justice but it doesn’t look like she’ll get more so she should focus on helping her daughter. In many cases, a girl who is raped at a young age may wind up becoming a prostitute which is no worse than a girl who was never raped and chooses to be a prostitute. It’s not an ideal life but it’s still life. Measures should be taken to make sure she doesn’t choose this path. I’m no expert but i’d like to meet someone like her to assess the damage and try to help.

        I can’t drink. I am very bad with alcohol. I love fruity mixed alcoholic drinks though. I got drunk from drinking 2 glasses of sangria one time. I couldn’t walk and my friend had to carry me. And then he dropped one of my shoe on the street while carrying me to the car. We didn’t realize it until later. Those were vera wang high heels. They were expensive..ouch…… :(
        I was more upset that I lost my shoe than making a fool out of myself. So embarrassing…..

      Great debate you’ve clarified there, i.e. (a) Get justice, situation done and dusted *vs* (b) Get justice, pursue for life. All said and done, this has been an excellent story for me as someone on the outside of China – with pertinence to, for instance, the Neil Heywood assassination, where if the UK’s Times newspaper had not pursued the story, Mr Heywood would have been just another foreign disappearance (like many which occur in Thailand each year).

        There are bounds of reason to each situation, none would be exactly the same. If something is very obviously fishy and pushed under the rug – vs. several people punished and put *to death*, that’s not really a comparable bounds of reason..

        I agree that some things need persistence of course. In this case, the mother went far beyond the bounds of reason, in my opinion. People were put to death. She expects them to be raised from the dead and put to death repeatedly. She expects the world to bend for her personal idea of “justice”, and potentially impossible-to-prove corruption or liars to be sent along with the horrible people who were already sentenced that way. That’s just insane..and perhaps it’s understandable after her ordeal that she went a little bit insane.
