Zhang Yimou Fined 7.48 Million For Violating One-Child Policy, Remin University Professor: Not One Cent Should be Fined

NetEase Entertainment January 10 report — January 9, Zhang Yimou fined 7.48 million [RMB, ~1.236 million USD] for violating One-Child Policy. The breaking of the news saw a huge clamor of public opinion. Quite a few netizens believe the fine to be excessive, while Remin University professor and sociology scholar Zhou Xiaozhen also said bluntly during an interview with columnist “奥德赛发”: “Not one cent should be fined.” His reasoning is “reproduction is a basic human right”.

With regards to Zhang Yimou being fined 7.48 million, Zhou Xiaozhen said “since ancient times, having children is the right of husbands and wives”, “Zhang Yimou used special privileges [his fame/connections] to protect his human rights. He had three children, and if he didn’t have his special privileges, then he wouldn’t have been given hukou registrations [for his children]. This isn’t a fault of having children, it’s Zhang’s fault for having special privileges.”

Netizens also paid a lot of attention to this matter. According to a certain survey, 38.6% of people believe the punishment was too light, with Zhou Xiaozhen expressing in response, “first, not even a cent should be fined. If he has special privileges, we should combat special privileges. Him having a hundred children is his own business, a basic human right.”

With regards to the National Population and Family Planning Commission, Zhou Xiaozhen says there’s no need for it to exist, “Immediately dissolve it. The National Population and Family Planning Commission has already been dismantled, merged it into the Health Department. In the Health Department, it’s called the Health Planning Commission, and its responsibility is the healthcare of women and children. Go take care of your responsibility, improve the healthcare of women and children.”

When I had to apply for a birth permit, I had to go to the community committee, the family planning office, town affairs office. They all said it was the responsibility of the others and refused to handle it yet wanted to fine me 5000, saying it was because I didn’t get a examination on time. Examination NMB~! This is my first child~ Finally I had no choice but to find a government leader [use connections] before they would handle it. The family planning office is TM just a waste of taxpayers’ money, completely superfluous~!

    Okay, joking aside, he knew the rules, even if you may not agree with them, he broke the rules and must pay the fine. I know many people who aren’t as rich as him and have had to pay the fine.

    What i would like to know though is how the fine worked out, is it a standardized price per child or a % of earnings? That’s where the question of fair comes into it.

      I was wondering the exact same thing Markus. I had heard it was some sort of sliding scale based on income. If you make 100,000 RMB/year you might get fined 20,000 RMB but if you were making 1,000,000 RMB/year you might get fined 200,000 RMB (numbers are made up as an example, I have no clue what the real % are).

    I agree with many of the comments of the Netizens; why didn’t he say something when the state was taking the pigs from the poor farmer, because he wasn’t a poor farmer? An action making it even harder to feed their children. He was only concerned with the in justice of the law when it affected him personally. A problem I fear too many of us have when we allow any government to dictate so much of the lives of our fellow citizens. Sooner or later they will come and bite us too.

    The other extreme is America; I taught in an inner city school in the States. I had students 15 years old on their second child. The government would send social workers to talk to the girls that were newly pregnant. Instead of informing them how not to get pregnant, they would inform them of all their benefits and entitlements they will get from the government.

    They actually told the girls if they have three children out wedlock the government is required to give them their own apartments. I and my first wife were evicted from our apartment in the States, because the landlord was able to get more money from a woman with three kids on state aid. The father still lived with them, but they were not married, if the social worker showed up he would just go out the back door. I was married with two, paying taxes, and had my rent raised so much I had to move out. Thanks to the American government.
    Whenever you give to one you are taking from another.Perhaps government should not be involved at all in paying you to have more, or fining you to have less children.

    this is such a tough topic…. there is definitely a population issue which effects everyone ( resources, pollution, etc… ) gut then on the other hand, I can’t imagine being told how many children I could have or whether I can even have children at all. i think something must be done to steady the rise in population ( globally ) but i just dont know what it is… it amazes me that with all of the family planning nonsense there is no sex education or access to the birth control pill on a larger scale… most of the girls i know in china have never even heard of “the pill” and the ones that have say they would never take them… if it such an issue why are they not handing them out on the street to anyone who is sexually active? and educate them on the benifits of using it.
