There is such thing as the basic law, and under the basic law, all criminal activity is prosecuted by the legal authorities. It is up to the prosecution to decide if there is a criminal offense to answer to, and then proceed with the prosecution.
Now we here os speeds of 110, and racing, but in a court, there must be proof, not hearsay, did he really go that fast? was he trully racing or just getting to the next street lights before they change? what is the speed limit on that road, and where is the proof of his speed?
On the other side, the guy that died. Was he Jay Walking, or being careless? was he crossing on a green light, and was he in anyway responsible in part for the accident? These are the questions a court needs to decide.
Then the net result if Guilty, Was it careless driving? would it be manslaughter or murder.
This is not a situation where the family of the Victim decide to prosecute, it is the responsibility of the courts to do their job. and for people to put their brains in and stop all this Mob Justice people.
