Internet Police Fine Man 1900 RMB For Downloading Porn

Yesterday, Nanyang City resident Ren Chaoji held in his hand a 1,900 RMB fine ticket, planning to apply for administrative reconsideration. The ticket was written out by internet police on September 12, with the reason: “Computer contains downloaded copy of a pornographic video.”

28-year-old Ren Chaoji and fellow Nanyang City Li Jin are business partners, the two of them having opened a car parts shop in a Nanyang shopping mall. August 18, internet police from a branch under the Nanyang Public Security Bureau came to the store, saying Li Jin’s computer was suspected of spreading reactionary (negative) information, and must be checked. To help facilitate doing business, in April of this year, Ren Chaoji brought his own computer from home, and at the time was also placed in the store.

Ren Chaoji said, the internet police at the time also checked his computer, after discovering that he had downloaded a pornographic video, they seized the host computer. Ren Chaoji says that the video was downloaded from the internet in November 2007, is about 30 minutes long. At that time, he had not yet gotten married, did not disseminate, also did not let others watch, was solely out of curiosity, and afterwards forgot to delete.

September 12, Ren Chaoji received the police’s letter of punishment decision, saying “routine inspection uncovered computer with downloaded copy of pornographic video,” deciding that Ren Chaoji should be given “a warning sentence of 1,900 yuan fine” . To this, Ren Chao Ji said he would apply for administrative reconsideration, saying that although him watching pornographic video is wrong, he said he watched it alone, did not disseminate, and he did not cause any serious problems, like a husband and wife at home watching a pornographic movie, whether it is illegal or not should be considered. He said, “The fine is too much, if I was fined 500 yuan, I could accept it.”

The Nanyang Municipal Public Security Bureau based its punishment on “Computer Information Network and Internet Security Management”, Article 5, item 6 and Article 20.

Article 5, item 6:
No work unit or individual may use of the domestic internet for the production, reproduction, access, and dissemination of “promoting feudal superstition, obscenity, pornography, gambling, violence, homicide, terrorism, and abetting crime.”

Article 20:
Violation of one of the acts listed in Article 5, public security authorities are to give a warning, those that have made illegal gains shall have those gains confiscated, individuals may be fined no more than 5000 yuan, work units may be fined no more than 15,000 yuan.

A Nanyang law firm is attempting to argue that Ren Chaoji should not be solely responsible for the crime, but that the site which published the video should be held accountable.

08/09/27 UPDATE: The police have “decided to withdraw” Ren Chaoji’s 1900 RMB fine after many netizens and media reported the story. However, they said it is only because it was Ren Chaoji’s first time breaking this law and not because the law is or the police were wrong. – Fauna

    this is truly happened in Nanyang , Henan province, China. not only once but many many times before. Just this case was exposed by media . The average salary of Nanyang people is about 800 RMB per month, so 1900RMB is not a small sum of Money. The policemen’s logic is ” If I don’t stop you watching porn video, then you probably could go further, like spread or rape etc more serious crime ” all of us know their real purpose is for “Money” nothing else.
