I guess if we are talking about intent it could depend on how close the tree was to the window and other evidence…

Please realize there’s a difference between looking at someone who chose to be out in the open and looking at someone in privacy. Your logic above and so many other posters’ on tianya and chinasmack is messed up.

And before someone uses faulty logic to critize my post, realize I’m not saying the sentencing was proper.
