
Hu Bin’s family has paid Tan Zhuo’s family 1.13 million RMB as compensation for their son accidentally hitting and killing Tan Zhuo while street-racing in Hangzhou. Hu Bin was driving 84-101 km/h when he ran into Tan Zhuo who was crossing the street at a crosswalk.

Wasn’t I just reading an article about how people get a couple hundred if they die. Now this guy’s family is getting millions.
If you had bothered reading instead of skimming you’d know that this was a settlement outside of the courts and therefore has nothing to do with the government approved limit for compensations through the court system. The retard’s family paid this high amount to make the victims family back off the case so that Hu Bin can get a reduced sentence. Since they knew they wouldn’t get more than at max 200K through the court they had to accept this. Everyone is,, well not exactly happy,, but probably better off. I still hope Hu Bin gets to serve some serious jailtime though. Sorry Hu but this is probably the right time to send a message and you were the idiot doing the stupid deed at the wrong time.

I’m sure he did not plan to kill anyone, but he certainly made a deliberate decision to put others’ safety – even their lives – at risk so that he could have a little illegal fun.
Tan Zhou did not just “walk out into the street” – he was killed in a marked pedestrian crosswalk. Labeling the dead victim an “ignorant, irresponsible idiot” for failing to adequately check for cars approaching at 100 km/h on a darkened city street seems a but much.

I’ll say again, IT WAS AN ACCIDENT. “Drag racing” is an assumption. Drag racing…85km/h? Uh, I watched my speed going over an overpass from city center to 1st ring in Chengdu going home the other day. The normal traffic speed on the INNER-CITY 2 lane street was ~70-75km/h. This is during a busy time of the evening, 6:45 or so pm, exiting downtown. 84km/h? RACING? bullshit.

Tan was killed at 8pm, it was dark at that time. Hu’s car was approaching at possibly double the speed limit, that means Tan would have had to see him at potentially twice the normal distance. Do we even know for sure that Hu was using his headlights? It’s not clear in the security camera footage. I often see drivers failing to use them.

Yes, the guy was on a crosswalk. Yes, the driver was drag racing with two of his friends, and he was doing at least 30km/h over the limit (50km/h).
Although I do agree that few people pay any attention to whats happening on the roads here – whether they be pedestrians, bicyclists or drivers.
I don’t know how it is in China, but in some countries (mine) driver is obligated to slow down to 20km/h before crosswalk.

In my opinion, whether or not the compensation amount is enough is a personal matter for the victim’s family. If they think it is enough (or a fortuitous windfall) as a civil compenation, that’s their business.
The more important thing to me is the criminal prosecution, which matter to the rest of us as a society. I’m not advocating for a harsher or a lighter sentence, but a fair one that matches the crime he committed. I agree with some commenters who pointed out that he didn’t intend to kill anyone. It was very much just negligence and reckless behavior on his part.
The MOST important thing is that he actually and fully serves his sentence, whatever it ends up being, in actual accordance with the law. All the outrage, anger, and resentment expressed in this entire escapade is a symptom of a legal system that has too often failed the people in serving justice. People don’t just hate the rich because they are envious, they’ve started hating the rich because the legal system allows the rich to operate above the law that everyone else is bound to. Ensuring that justice is blind and punishments are equally meted out to those deserving is an important step towards mitigating this growing social contempt and increasing dissatisfaction with the legal system. This is a feedback loop.
Chinese society needs to see a fair sentence and a fair fulfillment of that sentence. Only then can the system earn their respect.

The payment to Tan’s family may satisfy their personal need for justice, but justice is also due the rest of society. Public streets are shared by everyone, all must be subject to the laws which govern their use.
If drag racers, the wealthy, businesses, or anyone else find they can escape punishment simply by making a payment (which may not even be significant for them), not only is respect lost for the legal system, but reckless and criminal behaviors are not discouraged, and the public’s safety diminished.

I’m not familiar with China’s criminal law but I hope not! The death sentence should be reserved for the most malicious of homicidal intent and execution. Even if Hu Bin came off as a prick following the accident, there isn’t anything to suggest that he viciously intended to run down Tan Zhuo with his car for points or something.

The public seems to be getting distracted by this car’s modifications. A QQ traveling less than 50 km/h is perfectly capable of killing a pedestrian. Although Hu Bin was driving at an unsafe speed for the circumstances, the estimated speed of impact hardly suggests that he was racing, considering his car’s capabilities.
In all likelihood, he was just being a typical idiot distracted driver, like a large number of drivers on the road. Perhaps he got distracted by a cell phone or a text message or playing with the radio and took his eyes off the road.
At Hu Bin’s age, he would have the advantage of excellent night vision, and with a Mitsubishi Evo, a 100 km/h emergency lane change to swerve out of the way should be no problem. In other words, I think Hu Bin just didn’t see Tan Zhuo because Hu Bin was neglegent and took his attention off the road.
If Hu Bin is punished appropriately, it could be a positive turning point for Chinese society.
I agree and disagree. The car’s modifications are at best circumstantial evidence for his proclivity to engage in illegal driving behavior. The existence of modifications alone are insufficient to demonstrate that he was speeding or racing.
What can demonstrate that he was speeding or racing is witness testimony, video surveillance, skid marks (a bit harder depending on how you stop, especially with ABS), or even your car’s little black box. In this case, I think there’s sufficient evidence or testimony that Hu Bin was driving at least speeding and driving recklessly. Whether or not he was street racing is almost moot next to vehicular manslaughter, but I think he was indeed street racing.
His car’s capabilities are largely irrelevant. All that should matter was that he was driving dangerously for the conditions. The reports and comments from people in that area all suggest that the street is heavily trafficked. They also suggest that the street racers like to prowl there at night (I’m guessing when traffic dies down and because the road is straight or something). Either way, Hu Bin’s driving at the time both exceeded the limits of the road and the conditions (traffic and pedestrians). He clearly failed to see Tan Zhuo or he clearly lacked the skill to avoid him. How fast he was driving certainly contributes to that, regardless of age or the capabilities of one’s car.
I am not familiar with the law in China, anytime a pedestrian is hit in a crosswalk in the US, the driver is 100% at fault.

It is the parent’s only son. Chinese parents depend on their sons for support in old age. Of course they should take the money. That won’t heal wounds, but will at least provide them with some comfort in their final days. It is unfortunate. I hope Hu goes to jail for life.

this was no ‘accident.’ an accident is something that any reasonably normal person acting with clear mind and conscience cannot avoid. this was 100% the fault of Hu. Jail for 20 years.
The crossing where this happened now has three police officers on duty each night (during the busier traffic periods… they leave after about 8:00 or so) and small groups still gather on both sides of the street. One thing is certain, there are no racing engines or fast cars coming down Wen Er Xi Lu these days. Also, police have really cracked down on street racing as well as illegally modified cars in the Hangzhou area.

I agree with Kai. People who are calling for the death penalty are definitely being hot-headed. The boy is guilty of nothing more than manslaughter. Without knowing the precise details of the case, I would say that a fair punishment for such a crime would be 5-10 years in the slammer.

Sure. He didn’t intend to kill this person, or even harm him. That’s why it’s manslaughter and not murder or wilful murder. It was an accident. However, the accident came about through gross irresponsibility, thus the punishment should be more severe. 10 years in prison is actually a very harsh sentence for someone of that age, if you think about it. Even 5 years is a harsh sentence.
Come on, think about it. There is a huge difference between running someone down accidentally in your car and murdering them intentionally in cold blood. Don’t you think the punishment should fit the crime?
This is not Litigation money, this is Conscience money.
There is such thing as the basic law, and under the basic law, all criminal activity is prosecuted by the legal authorities. It is up to the prosecution to decide if there is a criminal offense to answer to, and then proceed with the prosecution.
Now we here os speeds of 110, and racing, but in a court, there must be proof, not hearsay, did he really go that fast? was he trully racing or just getting to the next street lights before they change? what is the speed limit on that road, and where is the proof of his speed?
On the other side, the guy that died. Was he Jay Walking, or being careless? was he crossing on a green light, and was he in anyway responsible in part for the accident? These are the questions a court needs to decide.
Then the net result if Guilty, Was it careless driving? would it be manslaughter or murder.
This is not a situation where the family of the Victim decide to prosecute, it is the responsibility of the courts to do their job. and for people to put their brains in and stop all this Mob Justice people.

The rich boy should be executed, but since we are not going to stoop to his level. He should be sentenced for 40 years of community service. Making china a better place.
Money doesn’t bring back life. But if he is forced to help the community. It would be a better punishment then jail, which is a total waste of tax payer money in the first place.
He should not be sentenced to death for this, but he should spend 5-10 years inside – and have a lifetime driving ban (with violations punished by another 5 years inside)
Don’t blame the family for taking the money. Thier son is already gone, and he was their pension. Now they won’t have to spend thier old age picking crap out of bins and begging for change.
